Beta Terms of Service

Language: English (the only official version of these Terms)

What changed in version 1.2. Window titles and full page addresses (without query strings) were added to what the telemetry collects, together with a per-application exclusion list in Settings → Privacy. This collection starts with a future release of the App; until you update to it, nothing described here as new is being collected from your Mac. The App will ask you to accept these updated Terms when that release arrives.

1. Introduction & Acceptance

Flowky (“Flowky”, the “App”, “we”, “us”, “our”) is a macOS desktop time-tracking application currently offered as a free public beta. Flowky is provided by:

an independent developer — Andrea Selmi, a natural person (sole individual provider) — based in Lecce, Italy. Contact: support@getflowky.com

These Beta Terms of Service (the “Terms”) govern your access to and use of the Flowky beta. They form a binding agreement between you and the provider identified above.

How you accept these Terms. You accept these Terms in two moments:

  1. by ticking the mandatory checkbox (“I have read and accept the Beta Terms of Service and the Privacy Policy”) on the Flowky download page before downloading the App; and
  2. by re-confirming on the first-launch screen inside the App.

Your acceptance, together with the version of these Terms you accepted, is recorded (the App emits a consent.granted event storing the timestamp and Terms version — see the Privacy Policy).

If you do not agree with these Terms, do not download, install, or use the Flowky beta.

Minimum age. The Flowky beta is not intended for anyone under 16 years of age. By accepting these Terms you confirm that you are at least 16 years old. If we learn that a user is under 16, we will terminate their access and delete associated data where we are able to identify it.

Version. These Terms carry a version number and effective date (shown above). We may issue new versions — see Section 12.

2. Beta Nature of the Service

Flowky is pre-release software made available to you for the purpose of testing and providing feedback. You understand and accept that:

  • The App is provided on an “AS IS” and “AS AVAILABLE” basis (see Sections 10 and 11).
  • The beta may contain bugs, errors, instability, and incomplete features, and may behave unexpectedly.
  • Data loss is possible. Your locally stored tracking data (sessions, tags, presets) may be lost, corrupted, or reset. Do not rely on Flowky as your only record of important information.
  • Features may change, be added, or be removed at any time without notice.
  • We make no promise that the beta will be continuous, that any specific feature will reach the final product, or that data created during the beta will be migrated to any future version of Flowky.
  • The beta is offered free of charge. No fees are due, and no refund policy applies (there is nothing to refund).

The beta exists so that we can learn from real use. Please treat it accordingly.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use one copy of the Flowky beta on macOS devices you own or control, solely for your personal evaluation and testing during the beta period.

You must not:

  • copy, redistribute, sell, rent, lease, or otherwise make the App (including the DMG installer or .app bundle) available to third parties;
  • reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the limited extent that applicable law expressly permits despite this restriction;
  • remove, alter, or obscure any proprietary notices;
  • use the App to build a competing product, or in any way not permitted by these Terms.

All rights not expressly granted to you are reserved by us. This license does not transfer any ownership of Flowky or its intellectual property to you.

4. Beta Program Participation & Email

To take part in the beta you may provide an email address (for example on the download page). We use your email address only for beta program communications, such as:

  • notifying you of new builds and important updates;
  • sending operational or safety notices (for example, a critical bug or a security issue);
  • asking for functional feedback about your experience with the beta.

These communications are part of running the beta program and are not marketing. They are sent on a contractual / pre-contractual basis (see the Privacy Policy).

Marketing is separate and optional. If you want to hear from us about the public launch or the future Pro version, you can tick a separate, optional, non-preselected checkbox (“Keep me posted on the Flowky launch”). That is marketing and is based on your consent, which you can withdraw at any time. If you do not tick it, you will not receive launch or marketing emails.

5. Telemetry & Usage Data

This is an important section — please read it carefully.

While you use the Flowky beta, the App sends usage data (“telemetry”) to a dedicated, isolated analytics service hosted on Cloudflare, kept separate from the main Flowky backend and from your optional account.

What the telemetry collects. The telemetry includes:

  • application usage events (for example: app launched, onboarding steps, settings changes, which surfaces you open, session start/pause/resume/complete/abort, sync diagnostics, upgrade-prompt interactions);
  • the names of tags and presets you create (raw text you typed);
  • the content of your session notes (raw free text, capped at 200 characters by the App);
  • the names and bundle identifiers of the applications you use while the App is running (for example “Safari”, com.apple.Safari), together with how long each was in the foreground; the title of the window in the foreground (for example auth.service.ts — flowky-api), which we use to tell your different pieces of work apart; for browsers, the address of the page open, including its path (for example github.com/andreaselmi/flowky) but never the part after the ?, which is where session tokens and similar values live and which is discarded on your Mac before anything is sent;
  • session metadata (planned and actual durations, pauses, completion or abort status, notification counts);
  • a randomly generated install identifier (a UUID created locally on first launch);
  • the App version, operating system, and OS version.

Special-category domains are filtered on your device. Domains that could reveal special categories of data under Article 9 GDPR — health, sex life or sexual orientation, religion, political opinions, trade union membership, or racial or ethnic origin — are removed on your Mac, before anything is sent, and never reach us. The filter combines a public academic blocklist with a list we curate, and we review it monthly against the domains actually received. It is not exhaustive and we do not claim it is; it is a technical measure to keep this category of data out of the collection, not a guarantee that no such domain will ever slip through.

Window titles are not filtered the same way, and we say so plainly. The domain filter above works because a domain is a short value we can match against a list. A window title is free text produced by another application, so no equivalent filter is possible, and one could occasionally contain something sensitive — the name of a document, a message subject, a channel name. Two things are in place instead. You can exclude any application in Settings → Privacy, and nothing from it is ever sent. And all raw telemetry is deleted within 90 days. If you would rather not share this at all, the beta may not be for you: telemetry is a condition of taking part.

This data is pseudonymous, not anonymous. It is grouped by the random install identifier, which is never linked to your account, your email, or any personal identifier. We cannot ordinarily work out who you are from it. However, because it includes a persistent per-install identifier and free-text you write, it is treated as pseudonymous personal data under the GDPR, and we describe it honestly as such (we do not call it “anonymous”).

Why we collect it. We use the telemetry for two distinct purposes:

  1. improving Flowky — understanding how the App is actually used, where people get stuck, and what to fix or build next; and
  2. building datasets to develop AI features for a future Pro version.

Telemetry is a core part of the beta. Understanding real usage is the reason the beta exists, so telemetry is on for the whole beta and has no in-app off switch. By joining the beta (accepting these Terms and, where applicable, providing your email) you accept this collection as a condition of participation. If you do not want to share telemetry, please do not join the beta, or uninstall the App to stop all future collection.

Legal basis. We rely on our legitimate interest (Article 6(1)(f) GDPR) in analysing and improving the product and developing future features, together with your acceptance of telemetry as a condition of the beta program. Your non-waivable GDPR rights remain: you can still object and request erasure by contacting us (using the install identifier shown in Settings), and all raw telemetry auto-deletes within 90 days — see the Privacy Policy for the full mechanism.

⚠️ Please do not put sensitive or third-party personal data into your session notes, tag names, or preset names. These free-text fields are collected as described above. Do not paste passwords, payment card numbers, health information, or other people’s personal details. Keep notes short and non-sensitive.

You cannot control what other applications put in their window titles, which is why the exclusion list in Settings → Privacy exists. If you work with confidential documents or clients, exclude those applications — Flowky will still record how long you used them.

AI processing. The datasets we build to develop AI features are de-identified before analysis, and that analysis may be carried out using third-party AI/LLM API providers acting as our processors. They never receive your account name, email, or install identifier. Full detail is in the Privacy Policy.

Retention. Raw telemetry events are automatically deleted within 90 days. Any longer-term datasets we keep for developing AI features are de-identified first (the install identifier is removed or hashed, and detectable personal-data patterns such as emails and phone numbers are scrubbed from notes and tag names) — see the Privacy Policy.

We never sell this data, never use it for advertising, and never share it with third parties for their own marketing.

Beta-only. This telemetry applies only during the beta and will be discontinued and dismantled when Flowky leaves beta.

6. Feedback License

We welcome your feedback. If you choose to send us any feedback, suggestions, ideas, bug reports, or other input about Flowky (collectively, “Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, and exploit that Feedback for any purpose, including to develop and improve Flowky and future products, without any obligation to compensate or credit you.

Please do not include in your Feedback any confidential information, or any personal data of third parties, that you are not entitled to share.

7. User Content & Acceptable Use

Your tracking data is yours. The sessions, tags, presets, and notes you create belong to you. Locally stored data lives on your device; if you use an optional account, some of it is stored on our backend to enable sync (see the Privacy Policy). The telemetry copy described in Section 5 is used only as set out there.

Acceptable use. You agree to use the Flowky beta lawfully and not to:

  • abuse, overload, or attempt to disrupt the App, the telemetry service, or our backend infrastructure (including exceeding reasonable rate limits or automating abusive volumes of requests);
  • tamper with, probe, or attempt to circumvent the telemetry or security mechanisms;
  • attempt to gain unauthorised access to any part of our systems or other users’ data;
  • use the App to store or transmit unlawful content or to infringe anyone’s rights.

We may apply technical rate limits and anti-abuse measures, and may suspend installations that behave abusively.

8. Optional Account

The Flowky beta works in guest / local mode without any account — you do not need to sign up to use it.

If you choose, you may create an optional account using an email address or by signing in with Google (OAuth). An account enables features such as syncing your data across devices via our backend. If you create one:

  • you are responsible for keeping your credentials secure and for activity under your account;
  • you must provide accurate information;
  • you can delete your account (and the associated backend data) — contact us at support@getflowky.com or use the in-app option where available.

Note that your account identity is never connected to the telemetry described in Section 5.

Note for the current beta: the beta is designed to run fully locally, without an account. This section applies only if accounts are enabled for your build.

9. Availability, Changes & Termination

Because this is a beta, we may, at any time and without prior notice:

  • modify, suspend, or discontinue all or part of the beta;
  • change, add, or remove features;
  • end the beta program entirely;
  • revoke a specific tester’s access (for example, in case of abuse or breach of these Terms).

When the beta ends. Any data stored locally on your device remains on your device (subject to any data loss inherent to beta software). Telemetry collection will stop, and the telemetry infrastructure will be dismantled. We will update or replace these Terms and the Privacy Policy for any successor version of Flowky.

We are not liable to you for any modification, suspension, or discontinuation of the beta, subject to Section 11.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Flowky beta is provided “AS IS” and “AS AVAILABLE”, with all faults and without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the App will be uninterrupted, error-free, secure, or free of data loss.

Nothing in this Section limits or excludes any warranty or right that cannot be limited or excluded under applicable law, including mandatory rights that consumers have under EU and Italian law.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of (or inability to use) the Flowky beta;
  • our total aggregate liability to you arising out of or relating to the beta is limited to a symbolic amount of EUR 50 (fifty euro), reflecting that the beta is provided free of charge.

Safeguard clause. Nothing in these Terms excludes or limits our liability for:

  • wilful misconduct (dolo) or gross negligence (colpa grave);
  • death or personal injury caused by our negligence;
  • any liability that cannot be excluded or limited under applicable mandatory law, including the inalienable rights of consumers under EU and Italian law.

If applicable law does not allow some of the exclusions or limitations above, they apply to you only to the extent permitted.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the version number and effective date at the top, and we will make the updated Terms available (for example, on the download page and inside the App).

For minor changes, your continued use of the beta after the updated Terms take effect means you accept them. For material changes to how we collect or use data, we will ask you to explicitly accept the new Terms again before you continue.

If you do not agree with an update, you must stop using the beta.

13. Governing Law & Jurisdiction

These Terms are governed by Italian law, without regard to conflict-of-laws rules.

If you use Flowky as a consumer, you benefit from the mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of your place of residence, as provided by applicable consumer-protection law. Nothing in this Section deprives you of those protections. For any other user, the courts of Lecce, Italy, have jurisdiction.
